Field engineers commonly work in the oil and gas industry and perform a variety of on-site quality assurance duties, including ensuring that oil wells are drilled and cased correctly; steering drill bits through oil reservoirs to maximize the return from an individual oil well; maintaining equipment such as oil tanks and drills in the field; and providing pre and post-job analyses. The demands of the job commonly require Field Engineers to work well over 40 hours per week and to be "on-call" for work 24 hours per day.
Many Field Engineers are entitled to one-and-a-half times their regular rate of pay for hours worked over 40 per workweek under the Fair Labor Standards Act (FLSA) because they are considered "non-exempt" employees. To be considered "exempt" from overtime pay under the FLSA, an employee must generally a) be paid at least $455 per week; b) be paid on a salary basis; and c) perform exempt job duties. While employers often try to escape the obligation of paying Field Engineers overtime by paying them on a "fixed salary," "day rate," or "per job" basis, they are entitled to overtime for hours worked in excess of 40 per workweek no matter the salary designation due to the fact that their job duties essentially involve manual labor rather than supervisorial functions.
